Midnight Sky Adventures LLC – Terms & Conditions

These Terms & Conditions (“Terms”) govern all bookings and participation in tours operated by Midnight Sky Adventures LLC (“we,” “us,” “our”). By submitting payment, you agree to these Terms.


1. Booking & Payment

  • Full payment is required at the time of booking.
  • Bookings made through TripAdvisor, Viator, GetYourGuide, or similar Online Travel Agent platforms are also subject to their terms.
  • Guests must provide accurate contact and pickup information.
  • Refunds, when issued, are processed within 7–10 business days.

2. Cancellation & Refund Policy

Guest Cancellations

  • Free cancellation up to 24 hours before the tour start time.
  • Cancellations within 24 hours or no-shows are non-refundable.
  • Missing your pickup time is considered a no-show.

Operator Cancellations

We may cancel a tour due to unsafe weather, road conditions, operational issues, or any situation affecting guest safety.

If we cancel, you may reschedule (if availability allows) or receive a full refund.

We are not responsible for additional travel or accommodation expenses.

3. Weather, Aurora & Wildlife

  • Alaska’s weather is unpredictable; tours operate in snow, cold, wind, rain, and limited daylight.
  • Aurora sightings are not guaranteed.
  • Wildlife sightings are not guaranteed.
  • No refunds are issued for missed aurora, missed wildlife, or unfavorable weather unless the entire tour is canceled for safety reasons.

4. Participant Requirements

To ensure safety and comfort for all guests:

Age Requirements

  • Age requirements vary by tour. Please review the specific tour listing for minimum age and any additional restrictions.
  • Minors must be accompanied by a parent or legal guardian and supervised for the full duration of the tour.

General Requirements

  • Guests must be able to enter and exit the vehicle with minimal assistance.
  • Proper winter clothing is required for Arctic conditions.
  • Guests must disclose any medical conditions that may affect safe participation.
  • We may refuse service to guests who appear intoxicated, behave disruptively, or pose a safety risk. No refunds will be issued in these cases.

5. Pickup & Drop-Off

  • Pickup is available from most hotels and lodging within Fairbanks and North Pole city limits.
  • Pickup outside these areas must be arranged in advance and may not always be available.
  • Guests must be ready at the confirmed pickup location at the scheduled time.

6. Personal Recording & Privacy

To maintain a comfortable experience for everyone on board:

  • Continuous or intrusive recording is not allowed.
  • This includes filming other guests without consent, running GoPros or action cameras continuously, or recording private conversations.
  • Casual photos and short video clips are welcome.
  • Guests who refuse to follow this rule may be asked to stop recording or may be removed from the tour without refund.

7. Photography by Guides

Guides may take photos during the tour for guest enjoyment and for Midnight Sky Adventures promotional use (such as social media, website, or marketing materials).

If you prefer not to appear in promotional photos, simply tell your guide at the start of the tour — we will fully respect your privacy.

Photos will not be sold individually without your permission.

8. Itinerary Flexibility

Due to weather, daylight, road conditions, aurora activity, or safety considerations, the guide may adjust the route, timing, or stops at any time. Flexibility is a necessary part of travel in remote Alaska.

9. Personal Property

We are not responsible for lost, stolen, or damaged personal items, including belongings left in the vehicle or at tour stops.

We recommend purchasing travel insurance for valuable items.

10. Assumption of Risk

By joining the tour, you acknowledge the inherent risks associated with Alaska travel, including:

  • Extreme or rapidly changing winter weather
  • Icy, gravel, or remote roads
  • Limited emergency services in remote areas
  • Slips or falls on uneven or icy terrain
  • Wildlife encounters
  • Delays or disruptions caused by natural conditions

Participation is voluntary, and you accept these risks as part of an authentic Alaskan experience.

11. Liability

To the fullest extent permitted by law:

  • Midnight Sky Adventures LLC is not liable for injury, illness, loss, delay, or expenses resulting from circumstances beyond our control.
  • This does not waive liability for gross negligence or intentional acts.
  • Our total liability, if ever applicable, is capped at the amount paid for the tour.
  • You agree to indemnify us for claims arising from your own actions that affect other guests or property.

12. Third-Party Bookings

If you book through TripAdvisor, Viator, GetYourGuide, or other partners:

  • Their rules may override or supplement these Terms.
  • Refunds for platform fees must be handled through the platform itself.

13. Updates to These Terms

We may update these Terms periodically. The “Last Updated” date reflects the most current version.
